Service The core service offered by byronbay.com Pty Ltd is listing each client's advertisement in the most appropriate "guide" on the byron-bay.com web site. The goal of byronbay.com Pty Ltd is to make it easy for visitors to find the information they are looking for. In order to use any of the services provided by byronbay.com Pty Ltd, you must agree to the following terms and conditions. Your agreement to these terms and conditions will be indicated to us by sending to us an application to advertise or any form of payment, whichever occurs first.

To meet the needs of the changing Internet, additional web sites, guides, lists, features, and services may be introduced and/or removed over time. We reserve the right to change the ways in which information, including client advertisements, are presented on the byron-bay.com and associated web sites.

We only publish material on the byron-bay.com and associated web sites that is suitable for all ages. We reserve the right to not publish material we deem unsuitable. We reserve the right to refuse service to potential clients, and we reserve the right to cancel service to existing clients to preserve the integrity of our websites.

The byron-bay.com and associated web sites are hosted on quality web servers and are backed up regularly. However, this does not guarantee the web site(s) will be available to all Internet users at all times.

byronbay.com may include links to third party sites which are not related to byronbay.com or byronbay.com Pty Ltd and in relation to which byronbay.com Pty Ltd has no control or interest. The appearance of those links on byronbay.com does not indicate any relationship between byronbay.com or byronbay.com Pty Ltd and that third party or any endorsement by byronbay.com Pty Ltd of that third party, its site or the products or services which it is advertising on byronbay.com.

Clients All clients using the services offered by byronbay.com Pty Ltd must be legally entitled to provide the goods and/or services they offer via their advertisement(s). All clients must own, or have express permission to use, all the material (graphics, maps, photos, text, etc) they request to be published by byronbay.com Pty Ltd.

Clients must understand that past performance in regard to visitor numbers, search engine rankings, etc. is no guarantee of future performance.

Clients may view the material published on byronbay.com or print a copy of the material on this site for personal, noncommercial use provided that the clients do not modify the copy from how it appears from this site (including any copyright notice). However, clients may not download from byronbay.com. All rights not expressly granted under these terms of use are reserved.

Clients will not use byronbay.com for any purpose or in any way, which is unlawful.

Payment and Billing Cycles We will email or post a tax invoice for all requested services, payable 15 days after the commencement of your billing cycle. Billing cycles start on the first day of the first month after a client's material is published. Unless requested otherwise, billing cycles are annual. Clients may choose a six-month listing. All prices for listing are displayed on www.byronbay.com

A renewal invoice will be sent by post or email during the month prior to your renewal date, and is payable by the 15th day of your billing cycle.

Payment options are detailed on invoices. Cheques must be made out to byronbay.com Pty Ltd and be accompanied by the tear-off slip from the bottom of the invoice. Electronic payments MUST quote the invoice number. It is important to identify your invoice number when paying, otherwise correct allocation of your payment may not be made.

Non-payment of invoices may result in removal from the website and suspension of services. If your listing is removed from byronbay.com for non-payment of services rendered, and you subsequently wish to re-advertise, a $55 including GST re-listing charge will apply. We retain the right to add administration charges to overdue and partly paid invoices.

Cancellation of Services Should you wish to discontinue your advertising, you must inform us within one month of your renewal date. Otherwise, the period of advertising that elapses from the renewal date until advice of cancellation will remain payable, plus an administration charge.

Refund Policy Refunds are not available unless prior arrangements are made with byronbay.com Pty Ltd. For example, if your business is for sale, we may agree to a pro-rata refund, less an administration charge, in the event it sells during your billing cycle.

byronbay.com Pty Ltd will have no responsibility or liability in relation to any loss or damage which the clients incur, including damage to clients' software or hardware, arising from clients' use of or access to byronbay.com.
